If you’re in California and your usual flavors have disappeared from checkout, you’re not imagining it. Two laws — AB 3218 and SB 1230 — closed the gap that used to let online retailers ship flavored products into the state, and both have been in force since January 1, 2025.
The short version: flavored vapes can no longer be sold to California addresses, by any retailer, online or in-store. But “flavored” has a specific legal meaning, and a fair amount of product still ships to CA legally. That’s what most of this page is about.

What’s Actually Banned
California already banned flavored tobacco sales in physical stores under SB 793, which took effect after voters upheld it in 2022. The loophole was e-commerce: an online retailer in another state could ship flavored products to a California customer, and the in-store ban didn’t reach them.
AB 3218 closed that. As of January 1, 2025:
- Online and mail-order retailers cannot sell flavored tobacco products to California consumers
- The restriction applies regardless of where the retailer is located
- Products containing synthetic nicotine and nicotine analogs are covered, not just tobacco-derived nicotine
- Enforcement sits with the California Department of Public Health (CDPH)
What is not banned: possession or use. The law regulates sale. Buying a flavored device legally in another state and bringing it home is a different question from having it shipped to you — and most domestic airlines allow vapes in carry-on.
The Two Laws, Briefly
AB 3218 — the online sales ban
This is the one that changed how you shop. It extends the existing flavored tobacco ban to delivery sellers, requires stricter age verification for online sales, and defines “characterizing flavor” broadly enough to catch products that mimic menthol without containing it.
SB 1230 — the Unflavored Tobacco List
SB 1230 created the Unflavored Tobacco List (UTL), maintained by the Attorney General. The logic runs the opposite direction from what most people expect: a product isn’t banned because someone identified it as flavored. It’s banned unless the manufacturer has certified it as unflavored and gotten it onto the list. Anything not on the UTL is treated as flavored by default.
Penalties for retailers who sell outside the list:
- First offense: $400
- Repeat offenses within five years: up to $6,000
- The CDTFA can suspend or revoke a retail license outright
This is why the CA-eligible product selection at any legitimate retailer is narrow and changes over time. It tracks the UTL, and manufacturers add products to it at their own pace.
Why “Cooling” Counts as a Flavor
The detail that catches most people out: California’s definition of characterizing flavor includes products that produce a cooling sensation, even with no menthol and no flavor additive at all. Synthetic coolants like WS-23 are covered.

What California Residents Can Still Buy
Unflavored and tobacco-flavored products that are properly certified remain sellable into California. The practical starting points:
- Tobacco disposables — the closest substitute for most people coming off a flavored disposable
- Tobacco vape juice — for refillable setups, usually cheaper per mL than disposables
- Nicotine-free options — a separate category worth knowing about

Nicotine pouches
Nicotine pouches are a different product category with different rules, and many California customers have moved to them. Common Questions
Is it illegal to own a flavored vape in California?
No. The laws restrict sale and delivery, not possession or personal use.
Can I have one shipped to a friend out of state and forwarded?
We ship to the address on the order and follow the rules for that destination. What happens afterward is outside what we can advise on, and we’d suggest not building a plan around it.
Why does a product show as available and then get rejected at checkout?
Eligibility is checked against the shipping address. A product that’s fine for a Nevada address may not clear a California one. The California page is filtered in advance and avoids the round trip.
Will the list of CA-legal products grow?
It can. The UTL is a certification process, so it expands whenever manufacturers submit and certify additional unflavored products. It moves slowly, but it isn’t fixed.
Bottom Line
California’s ban is real, it’s enforced at the point of sale, and it’s broader than most people assume once you account for cooling agents. But “no more vaping in California” was never accurate. Unflavored and tobacco products still ship, nicotine pouches are a parallel option, and the qualifying list grows as manufacturers certify.
